EB-5 Immigrant Investor Program

American freight. American jobs. A path to U.S. residency.

EB-5 lets a foreign investor — with their spouse and unmarried children under 21 — pursue U.S. permanent residency by investing in a U.S. business that creates at least 10 full-time American jobs. Valle Rose Investments builds and operates freight and logistics capacity in the Permian Basin.

Your capital must be at risk. Federal law requires it. No return is promised, no repayment is assured, and no one can guarantee that USCIS will approve a petition.

Timing matters right now

Two dates worth knowing before you decide.

These are statutory dates set by Congress, not a sales deadline. We would rather you hear them from us than discover them later.

September 30, 2026

The grandfathering deadline

Under the EB-5 Reform and Integrity Act of 2022, an investor whose Form I-526E is properly filed before this date is evaluated under the investment amounts and rules in effect at the time of filing — protection that carries through the rest of the case.

January 1, 2027

The first inflation adjustment

The minimums are adjusted for inflation for the first time. Industry analysts project the TEA minimum could rise from $800,000 to roughly $900,000, and the standard minimum from $1,050,000 to roughly $1.2 million. These are projections — USCIS has not published final figures.

The pathway

Six steps, in order, over several years.

EB-5 is a sequence, and each step depends on the one before it. Nothing here is fast.

Step 01

Invest

You place the qualifying amount into a new commercial enterprise. Every dollar must be traceable to a lawful source — this is where most petitions fail.

Step 02

File Form I-526E

The petition sets out the enterprise, the business plan, the job-creation model, and your source of funds.

Step 03

Capital is deployed

The enterprise puts the capital to work — acquiring equipment, hiring drivers and staff, and building operating capacity.

Step 04

Conditional residency

On approval, you and your immediate family receive conditional permanent residence, valid for two years.

Step 05

Jobs are created

At least 10 full-time positions for qualifying U.S. workers must be created and sustained, generally within about two years.

Step 06

File Form I-829

You petition to remove the conditions. If the job-creation and at-risk requirements were met, permanent residency follows.

Processing times are long and variable, and are set by USCIS — not by Valle Rose. Your immigration attorney, not us, advises you on your petition.

Where the capital goes

Into an operating business — not into a promise.

Valle Rose deploys EB-5 capital into freight and logistics operations serving the Permian Basin: tractors and trailers, terminal and maintenance capacity, dispatch, and the drivers and staff who run it. That is what creates the jobs the program requires.

Fees are charged separately from your investment capital and are generally non-refundable, whether or not a petition is approved. We would rather show you the whole number now.

Investment capital, deployed into the enterprise$1,050,000
Program administration fee$150,000
Origination, filing, management & administration$150,000
Total capital commitment$1,350,000

The $800,000 minimum applies only to projects in a qualifying Targeted Employment Area. TEA status is determined under federal criteria by USCIS — it is not something a project can assign to itself, and we do not claim it here. Your attorney will confirm which threshold applies to you.

Jobs you can count, in an industry that is short of people.

EB-5 rewards businesses that genuinely employ Americans. Freight is labor-intensive by nature: every tractor put into service needs a driver, and around them sit dispatchers, mechanics, and yard and office staff. The industry has a well-documented, persistent driver shortage.

The Permian Basin is one of the busiest freight corridors in the United States, moving sand, water, equipment and crude for energy and construction operators. Valle Rose operates from Midland, Texas, in the middle of it.

Job creation is a requirement you must actually meet — not a marketing claim. It is measured, documented, and tested by USCIS at the I-829 stage.

Risk

What can go wrong.

Any EB-5 sponsor who leads with safety is telling you something about themselves. Here is the honest version.

You can lose money

Capital is at risk, as the program requires. Freight revenue moves with fuel, rates, utilization and the energy cycle. A truck can sit idle, break down, or run below plan.

Your petition can be denied

USCIS may deny a petition — most often over source-of-funds documentation. Approval is never guaranteed, by us or anyone else.

Jobs may fall short

If the enterprise does not create and sustain the required jobs, conditions may not be removed at the I-829 stage.

Your capital is illiquid

EB-5 capital is committed for years. There is no secondary market and no ability to withdraw on demand.

Fees are separate and non-refundable

Administration, origination and filing fees are charged in addition to the investment and are generally not returned if a petition fails.

The rules can change

Investment minimums, visa availability and processing times are set by Congress and USCIS, and they change — including in 2027.

Our commitments

What we will never tell you.

EB-5 investors are targeted by people who promise things no one is allowed to promise. So here is what you will never hear from Valle Rose — and if you hear it from anyone, walk away.

✕
“Your capital is secured.”

It is not, and it cannot be. EB-5 capital must remain genuinely at risk. A sponsor offering collateral or a redemption guarantee may be putting your petition in jeopardy.

✕
“Your return is guaranteed.”

No return is guaranteed. EB-5 returns are typically modest — the benefit you are buying is an immigration pathway, not a yield.

✕
“Your green card is guaranteed.”

Only USCIS decides. Anyone promising an outcome is either misinformed or misleading you.

✕
“We’ll buy you out whenever you like.”

A promise to repay on demand undermines the at-risk requirement the program is built on.

✕
“Act now — spaces are disappearing.”

Real deadlines come from Congress, not from us. We will point you to the statute and let you take your time.

✕
“You don’t need your own attorney.”

You do. Retain independent immigration counsel. We will work with them; we will not replace them.

Questions

What investors ask first.

Is this the same as the $50,000 truck-ownership offering?

No. They are separate, and they work differently. The truck programme is direct ownership of a titled vehicle under a management agreement. EB-5 is an investment into a new commercial enterprise, governed by federal immigration law, with a job-creation requirement and an at-risk capital requirement. Do not read the terms of one into the other.

How much do I need to invest?

The standard minimum is $1,050,000. A reduced minimum of $800,000 applies only where the project sits in a qualifying Targeted Employment Area, which is determined under federal criteria. Fees are additional. Both minimums are scheduled to be adjusted for inflation on 1 January 2027.

Will I get my money back?

Possibly, and possibly not. Capital must remain at risk, so repayment cannot be promised or guaranteed. Any return of capital depends on the performance of the business and the terms of the offering documents.

Do I have to run the business or move to Texas?

No. EB-5 does not require you to manage day-to-day operations, and permanent residents may live and work anywhere in the United States.

What happens if the jobs are not created?

The 10-job requirement is tested when you file Form I-829 to remove conditions. If the enterprise has not created and sustained the required jobs, conditions may not be removed. This is the central risk of the programme and the reason the underlying business matters more than the brochure.

Is this a security?

An EB-5 investment in a new commercial enterprise is generally treated as a security and is offered only through formal subscription documents, under an exemption from registration, to eligible investors. Nothing on this page is an offer to sell or a solicitation to buy.
